Hi, i would like to know that if an employee wants to resign from the organisation who has taken her maternity leave and its been a month that she has joined the organisation ,does she have to pay the notice period salary to the company?

In that case plz go through your terms & conditions of employment as envasaged in the appointment letter or service rules of the unit applicable to your class of employees.

ok that means incase there is clause in the appointment letter that one has to serve 3 / 1months notice period or pay 3/1 months salary to the company for resignation then will the person (in situation of the maternity leave) have to abide it.

Gentlemen,
I need your advice. Staff was granted maternity leave (12 weeks) as per ESI Rule. She claimed as per doctor, 2 more months to be taken rest. Management cannot afford that extension due to workload. What to do? Since the staff's responsibility is distributed to other employees during her absence, mgt wants to continue the same and declare the position as redundant. Your advice is appreciated.
