Could any one let me know as per the laws how many total days of leave is an employee entitled to
Total leaves in a year
Casual leaves
Sick leaves
Privelege leaves
Also if he is a consultant how many leaves would he be entitled to .

There are 2 set of employees in a manufacturing set up.The leave entitlements are as under

1. Workers: The employee is entitled for one leave for each 20 days worked as per the India Factories Act i.e. Casual Leave as per the provisions of Standing Orders and Sick Leave at the discretion of the management. Normally it can be 8-10 days Casual leaves and 7-8 days of sick leaves. Please note this is in addition to PL.The PL is carried forward in the next year. In some organizations the some portion of unveiled CL and SL is converted into PL,but this is as per company policy

2. Staff: The employee gets 30 Privileged leave in a year if intervening W/O and Holidays during leave availed are counted as leave. if intervening W/O and Paid holiday during leave availed is not counted as leave 26 or 24 days of EL is allowed. In some companies where there is 5 working days the leave is allowed for 21 days. Additional 07 casual leave or 10 leave is allocated (Refer Standing Orders act). Sick leave is at the discreation of the management.

Apart from these leaves the employee gets public holidays and national holidays upto 6-10 days as per company policy.

Consultants are generally on contract and the leaves will be as per the term of contract The employee is entitled for one leave for each 20 days worked.

Dear Asmita,
According to "The Factory Act 1948" we have to provide 1 full day leave on each 20 working days to all the employees.
So as per the law the total no. of PL will be 15 in a calender year.
Regarding the Casual leave, it depends upon the provisions of certified standing order of the company. Generally it can be 7-8 in a calender year.
Regarding the SL, it depends upon the discreation of the management.

Casual Leaves varies from State to State eg in Model Standing orders applicable in Tamilnadu it is 10 days with pay whereas in some states it is 10 days with or without pay.
SL is as per Company Policy, if the factory is covered under ESI then we need not give SL

As per the leave law you should get the following casual Leave - 8 Sick Leave - 15 Privilege Leave - 30. But it is varying company to company. with warm regards Subhankar

You said as per "leave law"
As per law it is 1 full day leave for every 20 days of working by an employee.
so the maximum total comes to 15 leave in a year. It can not be 30 as said by you. You check up and if you have any update give me with reference please..

Hi Asmita,
In the current BPO culture the average leaves given for the employees is 24 / annum. The distribution of these 24 leaves completely depends on your company's policies. YOu can keep all these as a set or distribute them in to CL, SL and PL.
If you want to do that, atleast 50% of your leaves should be casuals. So, your leave count goes to
CL - 12
SL - 6
PL - 6
You can even have only two sets, 12 CL's and 12 SL's among which only the SL's can be carried forward to the consequetive year.

we are following this below leave policy for the company could any one guide to update the new Absence policy for the company .

Absence Policy

Allotted Leave (AL)

• All team members are entitled to 18 leaves (1.5 per month) in a particular financial year.

• Leaves are credited at 1.5 days on the first of every month.

• Leaves not taken will be subject to encashment at the end of a particular financial year.

• Leaves exceeding 4.5 working days in a particular quarter will be subject to deduction in the following month.

• The maximum duration for short leave is up to 2 hours.

• The maximum duration for half day leave is up to 4 hours.



Marriage Leave (ML)

The maximum duration of Marriage leave allowed is 7 days.

Paternity Leave (PL)

The maximum length of Paternity leave allowed is 7 days.

Special Leave (SL)

• There is no set no. of days for these leaves.

• The no. of days allowed are subject to vary depending upon the situation with the sole discretion of the senior management.

Compensatory Leave (CL)

Unused Compensatory leaves will neither gets carried forward nor encashed in the next financial year.

Calculation Procedure: Total Leaves credited quarterly – 4.5

1. If more than 4.5 leaves are taken quarterly, that would be deducted in the subsequent month

2. 3 leaves taken quarterly, then your balance 1.5 leaves will be carried forward to the next quarter and leaves not taken will be subject to encashment at the end of a particular financial year.

Penalty: More than 4.5 leave in one quarter - salary deduction in the subsequent month.

Reimbursement: Unused Allotted leaves will be subject to encashment at the end of a particular financial year.
