Hi, I am interested in knowing 1) whether call - centers are covered under labour act. Or is there any provision made. 2) If the call center closes without notice does the employee have the right to file against the employer. I also require help on issue : 1) If we appoint an candidate, we want to demote him. Can the employer do this. The demote is with reduce in salary. 2) Is there any provision in labour law on demotion by employer without specific reason or unsatisfactory reason. Kindly help me this. Regards, Bobby

Dear Bobby, Yes BPO is a commercial establishment and the Shops and Establishment Act of the respective State is applicable. In addition to above: PF, ESI, Bonus, Gratuity, Industrial Disputes Act, Industrial Employment Standing Orders are also applicable but is subjected to coverage which depends on manpower strength and kind of operation. Hi, Wants to confirm as am working in domestic BPO, Our company have not paid any thing for Diwali as Ealier we get Bonus or Double Wage for that Day but this time nothing in the Salary. More over company Deducted rs 250 form Everybodies salary for Headset " were and Tear " in the salary slip Under Miscellenous Deduction. Tell about the Incentive/ Bounus for any Nationalised hoilday if any one worked on that day. and second about the Deductions from salary.
