I came across this site while surfing.
I am in desperate need of HELP ,to find the solution for HR related problem presently I am facing.

I, stay in Delhi and I joined a Mumbai based company with a branch office in Delhi.
While serving for about 17 months at managerial level. Suddenly few months back my salary for the previous month was withheld without assigning any reason. I was forced to resign immediately.
Ultimately, keeping in view all pros and cons, I resigned in good faith that my earlier salary will be released. Full & final settlement after that in few days.
Even after submitting my resignation my salary has not released.
I contacted our HR manager and I was told you will receive it with full & final settlement after 45 days as per company rule.
Today ,even after passing more then 45 days I am continuously following with HR department but there is no satisfactory reply.
In nut shell my query is what should one do ,without job in the recession time, with three dependents and without salary for three months?
I hope likely, any one you will be able to guide or suggest the right step to be taken.

since they told you to quit you should not have given them a resignation letter. which will prove that you resigned. where you required to serve notice? if so then they may just adjust the said amount stating that you did not give them notice so they held your salary.
dont loose heart try for a job and keep asking for your dues. because going to labour law officer will not really help you as you have given the resignation letter.

i dont think labour dept will help you in this regard because you were on mangerial post.
what was your salary and nature of duties.it is required to see whether labour dept can help you otherwise you have to move to civil court.please clarify.

Dear Harshad, I have given one month notice after that there is no formalities, no clearance or any other correspondence in any regard. Regards. Sandy

Ideally all organisations take about 45 day to process the FNF. However, in cases where an employee has been asked to leave and that too for no fault of the employee, the FNF should be completed in about 2 weeks.
I would recommend you to write a mail to the CEO of the company with a cc to HR head and your dept head and apprise them of the situation. Hoping they would be empathetic to your situation, they should act fast. Please don't try to burn bridges in this situation.
