Would like to have a solution to this problem? An adult worker was employed in a factory in 2.7.2004. He worked for 130days in 2004, 229 days in 2005, 236 days in 2006 and 45 days in 2007. He enjoyed leave with wages under Factories Act 1948 for 5 days in 2005. He was laid off for 21 days in 2006 and he resigned on 1.3.2007. Is the worker entitled to wages in lieu of leave on resignation? If so, how many days? Please support your answers with reasonable explanation Regards

When we prepare full & final that leave will be calculated in pro rata basis. Earned leave will be for period of Jan to Dec so in that case leave will be cosider.

As per factories act, every worker is entitled for 1 day EL for every 20 days worked. He is eligible for EL and need to be paid during settlement.

2004 - 5 For every 20 days 1 EL
2005 - 0 No Sufficient Working Laws
2006 - 10 Lay off days 21 so we can take 236 days as eligible and calculated on those days
2007 - 3 Total 60 working days so 3 EL's

2005 = 229 working days + 5 leave with wages = 234 days, eligibility 240 days = Nil

Total Leave with wage =22 days already taken 5 days (22 -5 = 18 days) So he is eligible for 17 Days leave with wage .
