I am working on a research project and in pursuance of the same I am looking forward to have some relevant information regarding IT Companies as to -
Whether IT companies fall under Industrial Disputes Act or under
Maharashtra Bombay Industrial Relations Act? Do we need to get the
permission for layoff/retrenchment of software engineers? Are they
covered under the definition of workmen? Please throw some light on
relevant labour laws for IT and other service companies having all
white collar employees.

all IT companies are covered under ID act but if you company is located in maharashtra BIR will applicable to you ,it is a copy of ID act only.dear as per ID or BIR act,it is not the designation who decides that who is workmen or who is not a workmen ,it is nature of duties who decides this .if your nature of duties are managerial or supervisory nature than you are not a workmen.
see ,in one case the court said that MBBS doctor who is working in hospital
is workmen as his nature of duties are of technical nature.
