Hi Is there any law which prohibits dual or multiple employment in India? NJohn

Hi John If iam not wrong there is a section under factories act preventing the employees from dual employment. But iam sure there is a law existing that prevents employees from dual employment.guys correct me if iam wrong.

Hi John, As per satish said, its right, but not only in Factory act. Its applicable in all labour laws. Infact, Most of the orgnisation are mentioned the this clause ( that perticular employee will not be eligible for the dual employment without corrent orgnisation permission ) in their Offer Letter or Appointment Letter the movement they appoint anybody. But, there are some Legal way to do the dual employment is some cases. Regards, Tushar swar.

dear this section is given factories act and double employment is prohibited.we also mention in standing orders as well in appointment letters.

Thanks a lot I have found that Sec 60 of FAct puts onus on the employer, Sec 99 lays down the penalty on parents/guardians and Sec 9 of the Delhi S&CE Act puts onus on the employee on double employment I could not find any other act on this matter. I will keep you guys posted if I come to know By the way my question is not about prevention through employment contracts or Standing orders. Its about law or rule prohibiting dual employment NJ

Hi guys, I am desperately looking for an answer here. Which law and which clause specifically prohibits dual employment. Is is true that an employee can work in 2 different organisations when both his employers are aware, or will it still be a case of dual employment? Help!!! Saskari:?:
