Dear Sir, I am working as HR Officer in MNC company and i would like to have one clarification for Privilage leave availability. 1 ) One employee applies PL on thursday and he tells us that i will be back on monday since sat 7 Sun is hoilday,do we have to consider that Weekly offs also for PL availablity like four days. Dear Shashi, Yes! We consider Weekly Off in the PL if he will not join back on Monday. If he joins back and work on Monday than we have to give him Weekly Off. Regards Ranjeet

But, Mr Ranjeet, there is a problem while doing so. If the company is covered by Factories Act and as such only earned leave/ PL is in force without any casual leave, then holidays/ weekly off intervening such leave days shall not be counted as leave. Mr Ranjeet, It depends upon company police , why becuse some of the company working for 5days . In our company the policy of AL. 1)INTERVENING HOLIDAYS IS NOT COUNTED FOR THE PURPOSE OF AL. THIS MEANS IF THE EMPLOYEE TAKES LEAVE ON Friday and Monday ,he /she needs to apply only for two days. 2) Whenever a company holiday is observed during the vacation,(While availing of AL) that day is considered a holiday rather than AL. You have not mentioned the name of the Act under which your MNC unit is covered/ registered. Provisions of weekly off day is given under The Factories Act, Minimum Wages Act & the State Shops & Commercial Establishment Act ect.Factories Act,1948 section 79 Explanation-2 gives the details of payment of weekly off days & holidays comming in the period of leaves.Rule 23 of Minimum Wages (Central) Rules,1950 also provide guidelines for payment of weekly off day. According to this rule only unauthorised absence will disentitled the employee to have weekly off day payment.

In case he is resuming on Monday then you should count leave upto Sat. only, but if he is resuming on Tuesday then you check out your company policy whether they allow Prefix & Sufix or not. but as Madhu said is correct if its a factory as per act you can not deduct salary.

Hi, My self Mukta ,i am working with a LTd company, i wnt to know that i will take PL for 12days. so can i end my PL Prefix of my Weekly Holiday. For Ex: i will take PL on Wednesday and i will join the work one week after on Monday ,during 12days PL Two Weekly off are coming . i know first weekly off will be calculated as leve but can you tell me second one come under leave or not because On manday i join to work . so PL will be calculated upto Saturday or Sunday? in 12 days PL will be consider tow weekly of ? I have put my observation that if your establishment is covered by Factories Act, the PL is calculated as per Factories Act (under Factories Act leave earned is called annual leave) then any weekly off or holiday intervening the leave days will not be counted as leave. Otherwise, any holiday/ weekly off intervening a stretch of PL/ EL will be counted as PL/ EL, as the case may be. In any case, if you join back to duty on Monday, your leave will be counted upto Saturday only and prefix of resuming duty being holiday/ weekly off will not be leave day. Regards, Madhu.T.K
