An employee from our company was sent to Saudi Arabia and his visa has expired over there,
Since the visa is in arabic he couldnt understand the expiry date , he submitted his visa 7 days after expiry and now its been more than 3 months of over stay there.
Our compnay had sent him over there on a non work visa and now the company is asking the employee to pay a fine of rupees 1 Lakhs to come to india.
No mail regarding the reminder of visa expiry was sent to him , also he had no idea about the visa expiry.
The employeee submitted the visa 2 montsh back and still its not been renewed and the caompany amde him work over there risking his life.
Now when he wants to come back to india the company is asking fine of rs 1 lakhs from him.
The company amde him to work telling nuthing to worry , nowwhen project is dleivered they are asking him 2 pay fine 2 come back 2 india
What can be done in such case , who should be paying the fine the employee or our company ?

As far as I know the company has cheated the employee, and its too dangerous to remain in Saudi without Visa their laws are too strict and they just give any punishment. Better ask your friend to come to INDIA by paying one lakh rupees and once he comes to INDIA he can collect lots of people and then cut the company HR n Manager into pieces n demand compensation, first let him come out of Saudi, its laws are too strict, once he comes to india everything can be managed because INDIA is INDIA n SAUDI is SAUDI

Don't worry,these things are common in middle east especially in Saudi Arabia........Take out your friend from KSA immediately at any cost.Track the whereabouts of the management people(Target Personnel and HR people, they are behind such kind of activities) of that company and the agent/consultant who provide the visa in India. Be bold........Give quotation to third parties to finish off the mission........

Well. The primary responsibility of paying fine for the employee is ofcourse with you, since he is merely an agent of you sent for working over there.
Now if you dont pay, the person who is working over Soudi may be punished by the soudi courts simply for violation of local immigration laws.
A natural question will come, why you will pay and why not the company under whom he was working over there. I agree if such question comes with you. It is the company who are in charge of managing visa for him. But remember they are in a more advantagous position.
So what I feel you should pay the defference and get the person out of a foreign country and then file a complaint with the Indian Office and also file a criminal complaint over there.
