This is most urgent..
1.Shall we need to cover all the probationers under ESI and EPF?
2.Is there any provisions to avoid this?
3.How about apprentices?Should they be covered under PF & ESI?
4.How long shall we keep apprentices as apprentices?

Hi Jayaseelan,
All the employees including probationers, trainees and contract labour are covered by PF and ESI. These are the statutory benefits and if you ask how to avoid, it is illegal and could not be discussed in a forum like this.
As per the Apprentices Act 1961, the employer has to pay the stipend and it doesn't attract the statutory benefits except the liability on the part of the employer to pay compensation in case of injury to the apprentice as per Workmen's Compensation Act. The period of training for apprentice will be determined by the National Council and there exists an apprenticeship agreement and this has to be registered with the Apprenticeship Advisor. The hours of work applicable to regular employees are also applicable to the apprentices apart from leaves and holidays and all other provisions of safety and welfare are applicable to apprentices as indicated in Factories Act or Mines Act.

Am completely agree with Pradeep & pls follow with his view. Apprentices are joins only for their on the job training as per their agreements & they do not be deemed as bonafide employees. So there is no needs to cover them under PF & ESI.
