Dear all,
one of my causin have joined one of the wll known company & have been working there for from last one month. he is not satisfied with his job profile and work culture & so wants to put the papers.
In the appointment letter its mentioned that probation period will be of 6 months & also there is clause of notice period of 3months from either side. But in that notice period clause it not mentioned that whether its appicable after completition of probation or during probation also.
Can he able to resign on the short notice of one day or max week? or he will be liable to ocmplete the notice period in probation also?
Please guide.

Normally during probation,one day notice exists from either side.Your friend can ask the HR of that company regarding this notice period and 3 months are generally applicable for permanent ones.The best is clear it from HR department.

No, he has to put notice period, otherwise there is no way to get out of the company...if at all he wants quit the comapny earlist ; he has pay for that....he has to discuss with the HR regarding this by giving them some personal reasons behind this....

I agree wid Sam.... As in probation period One day notice is enough from either sides...He need not to serve any notice period for that but he should talk to his HR in detail.... Regards SJ

Hello Sam,
As few of our friends have have specified industry practise is one day notice for Probationary associates. Please talk to your reporting Head and also the HR. The policy can be flexible at times. Please discuss, they make release you.

If there is mention of 3 months notice period in the appointment letter, for all the employees irrespective of his probation/permananacy status, then he has to serve the notice period or pay for the same & now many of the companies have 3 month's notice for probationers also.

Its really surprising that company has mentioned 3 months notice period in probation normally it doesn't happen. Tell your cousin to speak to reporting person and HR well, it will help out the situation.

Hi All,
If he has agreed and signed in that copy (which states about the 3 months probation), he should abide by that.
Otherwise, he should be prepared to pay for the remaining period along with some valid personal/health reasons.

Dear shiti As per indian law and labour rules no is liable for any cause or resignation during probation. however ur cousin had not signatured it on the stamp paper. regards shekher

It doesn't matter for resignation during the probation period. Since you were not complete 6 Month probation. I could say, if you complete 6 Month probation then you should give notice period for them atleast 3 Months as it has mentioned in your appointment letter. :)
