Dear Members,
Please help me with the following case:
One of our employees was sent on a 2 months leave without pay for his misconduct. After 1 month, he sends his resignation by mail.
(Our co. has a notice period of 1 month.)
Should I relieve him after 1 month from now, although he is on leave during this period?
Or, does he not get any service certificate, relieving letter, etc. from our co.??
Please guide me.

Already he is a problem making personnel for you. If he has sent resignation, don't wait for acceptance, just accept it and relieve him. By relieving you are not giving any assurance that his conduct was exemplary but it is only an order stating that he has been relieved from official duties.

Dear Srishtee,
Juz accept it n do nothing. Let him approach u, provide all formal letters after 2 months frm nw, thus notice period is fulfilled or if he asks for imm. relive, ask him to pay for notice period, 2 months leave is not considered under notice period.
