I resigned my job in the year 2004 from a delhi based company where i was in tirupur branch. They kept my name in one concern for 3 years and chnged in to their sister concern for another 2.5 years. In both of the company my name was in PF role. Now they deny that i am not eligible for Gartuity.
Pls can anyone help me, how i can go for claim/
Whether i am eligible for that or not?

Please let me know the following details.
Date of joining in the first concern
Date of transfer to the second concern
Date of resignation from the second concern
Is transfer order is provided when you are transferred from first concern to the second concern?
Is your PF account no is same in both the concern? If not the PF amount is transferred from first concern to the second concern?
Is both the concerns are belongs to the same employer?
If you provide the above details, it will be easy for me to suggest you regarding this.

are you received your releiving order / Experience Certificate, in that what they are given your Date of Joing.
In that they are given your first DOJ , you will get gratuity
if they are given after transfer DOJ, it is not possible

Dear Mr.Venkatesh,
I joined on 19.March.1998 and relieved on 30.April.2004. They never give any transfer letter or even appointment letter.
These information were accepted by the employer bty the letter they sent directlky to PF office for my PF cliam which was directly sent to PF by me.

i have joined one company in year 2004 and been tranferred to the sister concern company after 2 years, now i have left the company in year 2010 completeing 6 and 1/2 years in both company, i have the appointment letter, transfer letter as well from one company to another copmpany.
Am I eligible to get Gratuity on the basis of my entire tenure in the copmany ??
