PL help me..
Actually one of my friend is working in a company for last 08 years. He has a very good relations with his Boss. But now due to very old age Boss does not turn up to office & instead his son who is just 26 come's & handle's the entire business.
Boss's son is very short tempered & he mentally harresses all the employees many a times he has also injured some of the employees physically.
Now my friend wants to leave the company but ne boss thretan's him saying that he will file a fraud case against him. My friend had signed on a blank paper which had revenue stamp on it last year as well as yesterday. He was told that this sign was to confirm the receipt of Diwali Bonus.(Each employee had signed on it )
My friend thinks that his boss will use this paper & write any thing boss wishes to prove him a culprit.
Plz help me & let me know what misuse can his new Boss do with the signed blank paper with revenue stamp. Moreover my friend has not mentioned the date below his signature. Also pl let me know all the legal aspects.. What his new boss can do?? & How can my friend escape form this dirty politics.
My friends new Boss does'nt even allow him to resign & harresses him mentally. My friend is so frusted that he thinks of commiting sucide; He is such a dilemma that he can neither quit the job nor can he work properly & the worst his family is totally disturbed.
Also pl let me know how can he resign?
If he resigns without notice will there be any problem??
Is there any legal procedure to Comeout of this??
Or will he become the scape goat for his boss's dadagiri???
Plz help me.....

Please approach to Maharashtra Navnirman Sena local office these days they are fighting against such nature of harrashment.
Do not hesitate of approaching them irrespective of propoganda factory of our mordern age may have projected them as evil forces but they are good in this and you have to see their positive strength.

Have some proof for Harrasmnt n go to labour court, revenue stamp sign will be useful for only receipt of payment n tatz it. juz ask him to consult an advocate n resign.

Intimidation and harashment cannot be dealt with labour laws. We used to keep worker away from joining the factory despite of labour court re-instatement with back wages order for years stating worker is not reporting to work and subsequent dismissals. THere are many tacticle moves to victimise workers. Bribing Labor Officer or conciliation officer is also one famous act.

Other than this we have many ways to force worker even transfer to another site where he is not interest to work at all just to harrash and force him toresign.

This son of proprioter has many means and ways to harrash despite of Labour Court and Law enforcement machinary has no tooth to bite him.
The best way to treat such elements of society with their weapons.

You must approach to appropriate social reformers who are capable to deal with such people and such employer shall have some respect and afraid to take on them.

Don't follow bookish approach this will fail. There are some sulutions which only can be only practical in given circumstances.

I would suggest dont take up a hasty decision.Do wait and see.
First understand why is he behaving like that is this BCZ of the employee's mistake OR it his mistake.
As you know young blodded people will expect the employees workhard and quick turn around time.check if you are meeting his expectations or explain him practical reasons why you are not able to meet the expectations.
Think in positive way , try to be close with him .
Dont share any of the office issues at home.
IF find this is very difficult.As you have been working at the same company try to meet ur ex boss.
Would suggest Try to talk to him and try to be close with him.

I suggest go to Police Station file a NOC against your Boss intention that he can harm you Physically, Mentally and Financial so anything happen to you, He is responsible for it. Also mention them that He have taken your signature on Paper by threating Physically.
As there is most proverb - Tits for tat.
You warn your boss if he give you any type of torture , you will commit Suicide. May be he also fear about it reputation and relatives comments.
I also suggest you to talk to his father and mention the problem and get the guidance from him.
For precaution purpose always carry a Tape recorder when you find he will speak a ill and threaten you. Never speak any thing wrong as the same will get recorded in tape recorder.
even you can use Latest Mobile having a voice recording facility.
Sometime we have to try the crook tips. JAB GHEE SIDHI UNGLEE SE NAA NIKLE, TOH UNGLEE TEDI KARNI PADTI HAI.

Hi,

My suggestion in this regards is to avoid fight or argument with the owner coz Boss is always right.

First check where we are wrong, if really we are not wrong then go and ask directly with humble words to continue work

coz we can not find enough time to fight in the court better if we are enough qualified then meanwhile find another job resign current job.

after finding the job dont stop even your boss request at any cost.

try i think this will work it my personnel experience

reason if we are so much rich then why we are working with anybody why dont we business even business is also a hard nut so try to bear and take action if opportunity is there

last but not least i am working in a group of companies as a Manager Finance & Accouts and there are four bosses but i am handling since March 2007 means if your are well equipped then no body will challenge you if challenge then he will lost his best assets.

We discuss everything like philosopher and MBA students here on board. If your boss is assulting the employees then his criminal behaviour shall be dealt with appropriate measures his bonded labour kind of treatments treating employees like midieval age slavery system used to be not appropriate to deal with labour laws.
If our HR fails to distinguish between formal Labolur laws and criminal acts they exhibits inexperienced and poor judgements.
