I want to know whether Gratuity amount is paid by employer or Employee?
Further I want to know the gratuity amt. is paid by employee as a part of CTC- Will I get this amount back if I tend to leave the organisation before 5 years.
To my best knowledge, you become eligible for Gratuity only after 5 years of service.Isn't It?

Dear Rakhee,

Gratuity is paid by the Em-er to the Em-ee. This is a part of the CTC. If you refer the gratuity act then you will come to know the eligibility of it. If you left before, completing 5 yr continuous service then u will not become eligible to get it.

dear
gratuity is paid by emplyer to employee after completing five years of service or in case of death before completing 5 years of service.it can be a part of ctc but u will get it only if u will complete 5 years of service.

It is actually been deducted from Employee's CTC so it is indirectly paid by employee.
If a company states that your gratuity will be deducted from the date of Joining that means your amt. will be deducted every month but you will get if after 5 yrs and if you leave the co. before than its gone.
In this issue can be plz suggest how can we negotiate with the co. not to deduct gratuity. :-)

Hello Rakhi,
you need to understand the CTC funda first...
Being part of CTC is different and getting diducted from salary is different.
Refer to the post explaining the CTC here on citehr.
If you think that garduity is being taken from employee's pocket than you will also come up with an issue that an employer is taking away 24% of base salary as PF amount which is not actaully the case.

it is written that the x amt. will be the deduction from your salary on monthly basis as a part of Gratuity from the date of joining
And have also added the clause - "Please note that the Company PF and Gratutity have been deducted from the Special Allowance Bracket as the salary specified is Cost to Company."
Can you plz explain now?
