Is gratuity applicable in the case of employees in a charitable association registered under the travancore cochin literary scientific and charitable societies registration act, 1955?
I'm working in one such organization in a different post but would like to help.

How can we calculate the amount of gratuity..? Secondly as per my knowledge its applicable to those who have working exp of 5yrs in same org. but does calculation differ if exp is more than 7 yrs and above...?

tks for suresh/meenakshi.i would like to little bit different on this querry as no where it is written in gratuity act that gratuity isnot applicable for nonprofit or charitable organisation. so gratuity act is applicable here and it will be calculated with no of years of serv ice.

The payment of Gratuity Act applies only to factory, mine, plantation, port, railways, and to every Shop and Establishment in which 10 or more persons are employed in Govt/Pvt companies.
Is your Cochi office registered under Kerala Shop and establishmnent? If so then Gratuity is applicable. Generally NGOs and NPOs run with a skeleton strength for social cause and don't book profit. So I don't think Gratuity or bonus is applicable even if you complete five years.
To be eligble it has to be under any of the above listing that involves high manpower, production, cash flow and P/L Account.
If they are so conscious, they can equate a proportionate amount in lieu of Gratuity.

Hope your doubt on non profit organizations has been clarified. Regarding the calculation, you may follow the below formula.
Last Drawn Wages X 15 X No. of years of Service = Gratuity
26
Again a person's experience is more than 4 yrs & 240 days, he is eligible for gratuity. Books may say 5yrs continuous service, but Judgements has concluded for less than 5 yrs also.(4yrs & 240 days)

Can you please give me a reference of any judgment stated that, the Person have served 4yrs & 240 days, continuous service , will be eligible for Payment of Gratuity.
Also I want to know that, whether 240 days continuous service means including Holidays/w-off/Leaves or not?
