We had a strike at our factory previous year. The workmen filed up a case against the company & have lost it .This happened in May'07. They are coming now to fill up their pf & pension forms.
My question is from when will the people receive their pension (those above 50 yrs).From the date of their resignation or from the date the forms have been submitted or from the date the forms have been processed.

Dear Aparajita,Please note only when employees resigns/ separation or VRS can opt for PF withdrawal.For application to Members pension at the age of 50 years onwards and two months after their resignation or separation from the company need to apply.This process starts from the date of submission of the Application from in 10D for members pension to the PF authority. With regard to withdrawal in form 19 and apply for Pension Scheme Certificate if not obtained from PF office.With regardsS.ShamalaBangalore

For receiving Pension under the EPS the date of losing of job or releiving is irrelevant but the date of birth is relevant. He starts getting pension on attaining the age specified in the Act, ie, 58 years for full pension or 50 years for reduced pension.
