Hi Siva,
I am getting many confusing inputs for PF. We are a small organisation with 25 strength. Most of them have basic higher than 6500. We dont have DA. So if PF registration mandatory?
Secondly, one of my friends updated me stating that PF is not compulsory for first 3 operating years of any organisation. Is this true?

An organisation with 25 employees will be covered by EPF. Since all are drawing salary not less than 6500, the employees are not covered. However,monthly return in form 12 and annula returns in form 3A are to be filed.
There is no infancy protection now available.

in that case pension amonut is same alredy deposited , on the basis increase basic as arrear calcultion 12% will be deposit.

Dear All, Please let me know if a company, which is a Proprietor ship, is it compulsory to have a pf account or it depends solely on the owner’s decision? Please let me know....

Once covered an employee will continue to be covered under the EPF. On his leaving the organisation and joining a new concern at a salary of not less than 6500, he can opt for exemption.

I seen a case in which PF membership is being discontinued on the demand of Employee, his contribution was sent for a month and he is still employee of this organisation.
Kindly suggest, is it correct by Law? and if not then PF authorities can counter check the same or not? what are the other consequences for the same?

Dear Jani, the same is not correct as per PF rules once a member will be always a member even if his salary incresed form 65,00 to 15,000/-. His contribution is payable on 65,00/-. But once the member withdraw the PF amount and settle his/her account with the PF department then he/she will cease to be member of PF Fund. As the eg given by you may cause problem for the employer, the contribution is liable to pay in respect of such member.Can not dicontinued the contribution.You can do one thing ask the member for resignation, and withdraw his/her PF amount.then fresh appointment more then Rs 65,00/- then take form 11 stating i am not a member of PF amount. But it amount to unfair labour practice as you deprive him for benifit pertaining to continuty of service.Hope will stisfy your query.
