Dear Member, Plz go through section 4 of the Payment of Gratuity Act, 1972 for clarification in the matter.

Im V Krishnan,working as an executive accounts in last 5.7 years in same coy.But now i want leave this organisation. While my joining period there is no any appointment order & any policy to resign.But HR peoples are told now,prior notice should must for 1 month. If i resign my job with working days of 24 or 26 then how much amt i will receive for gratuity.
Basic - 5050
Children Education Allowance - 250
City Compensatory Allowance - 2500
Conveyance Allowance - 1263
House Rent Allowance - 1768
Leave Travel Allowance - 250
Medical Allowance - 200
Mobile Allowance - 100
Out Station Allowance - 1000

Dear Mr. Krishnan,
For computing Gratuity only Basic +DA+VDA is taken into consideration and all the allowances which you have mentioned above are excluded. In your case 6 years of service is considered since a part of six months in excess is regarded as one year.
Therefore your Gratuity calculation will be 5050*15/26 *6(years) = 17480

Dear Sir, My question is, if any one serves 5 years and 4 months continuously, then what will be his service period considered at the time of calculating amount of gratuity? 5 years or 5.4 years.
