if a person worked only 28 days in a month during the year should we take 28 days of basic salary for that month for bonus calculation or we take the full month
From India, New Delhi
Shifali it depends upon the cash you have given to the employee if you have paid him the salary for 28 days then you will calculate the Bonus on 28 day's salary but if you have considerd the remaining days as leave and paid him full salary for the month then you will calculate the Bonus on full month's salary.
From India, Delhi
As per setion 8 , The payment of bonus, bonus is payable when the employee worked not less 30 days in any preceeding calender years. so for 28 days no bonus shall be payable.

Dear It is rightly pointed that an employee is required to work for 30 working days in an accounting year to become entitle for bonus. Regards, R N khola

Dear Sirs,
Please lete me know, Statutory bonus will attract the ESI deduction. i.e. we are planning to give the bonus for contract labours monthly in order to attract them, so this monthly payment will attract the ESI?

Although there is no provision for payment of bonus on monthly basis, bonus has to paid annually.
Yes, if you are paying bonus on monthly basis it will attract ESI contribution. Any payment which is being paid to workers regular beyond two month will attract ESI Contribution as per second part of definition of wages under ESI Act.
Regards
