Dear Sir,
The provision in the Act reads about disqualification of employee from receiving bonus if he is dismissed from service for theft......Therefore, the question is whether you have dismissed him for theft? If it is proved that he is guilty of theft, then he is disqualified from receiving the bonus for relevant year.

The query which is raised by anonymous is not interacting with the members of the opinion. He is not also revealing any reality. In absence of this it is difficult to under stand whether this is a real incidence or hypothetical.
No where is proved that the the boy is guilty Unless the domestic inquiry into the charges alleged against the delinquent, we cannot held any body guilty and forfeit the bonus amount. The steps of forfeiture of bonus amount which is specified our learned members are quite well. In the absence of disciplinary proceedings I am of the opinion that to keep the bonus payment in abeyance and complete the procedures and proceed based on the findings of the inquiry officer.

No doubt that one should deal with people keeping humanity in mind,but if wrong is done punishment needs to be given proportionate to the offence.

Its up to the management to pay the bonus or not. In case if you not pay bonus to him their will be no legal issue but in religion manner it is sin who know you may get punishment in heaven? for stopping some body bread butter money. so better pay it bcs you are not paying from your pocket.
