Hi,
Pf will not be applicable but as far esi is concerned it is applicable in municipal limit for city where esi is applicable like ahmedabad industries falling under Ahmedabad Municipal Corporation falls under ESI but if industries is in outer limit of Ahmedabad Municipal Corporation will fall under Workmen Compensation, so pf & esi will not applicable.
But whether your industry falls ESI or Workmen depends upon location and i am not knowing much about workmen compensation :?:

1.The contractor has to be registered under contract labour act.
2.If PF and ESI is applicable to the organisation then, PF and ESI does apply to contract labour as well.
3. There is another way to comply pf and esi. If the contractor is already registered under PF and ESi, and already has PF and ESI code then, the contractor can contribute towards PF and ESI and the principal employer does not have to comply.
4. Lastly, if the principal employer contributes for PF and ESI on behalf of contractor then the principal employer has the right to deduct the same amount from the labour bill of the contractor.

it is very good bedat and fruitgul message to follow. Eventhough the
contracter has not covered, the principal employer is responsible for the
same. The PF and ESI authorities will check the wage/salary bill and
definitely they will catch the principle employer only

There is a main contractor under outsourcing. He has EPF code. Can he share his code to Sub contractor whose strength is more than 20. Regards.

If the principal employer is covered under pf & esic their contractors or contract employees should cover PF & ESIC even the employees less than 20 and employed one day also.

Dear all
i have some another similar case where ours was IT company where two company's were working together but due to some of the reason we have separated one company and few members from earlier company wants to shift to 2nd company,
now what i want to know is do we have to register ourself (for 2nd company ) as new company ?
in earlier company we used to not dedcut PF for all employees. because most of the employees were paid more than 20 k per month.
Please suggest is it possible for us to do so.

Dear Amit, As per the labour act 1970, If any contractor employing labour even if 2hrs then he have to provide PF & ESI. Otherwise it will not be compliance.

In case Of A Company having registration In ESI But Sub contract Dont have register. in this case company deduct pay or not

Dear All,
We have employees on contract basis (agreement with us only, no sub-contract), who works on hourly basis, around 50 contract employees works around 3-5 hours per day.
1. Is ESI and PF applicable to him?
2. Apart from these, do any other compliance are applicable for them?
