Ex-gratia is not governed by any statute. It is governed by company's policy.
In CTC structure if there is a mention of Ex-gratia is payable subject to name of employee is borne on muster roll of company on the date of payment of Ex-gratia, then there remains no ambiguity.
Else, you will get different views.
Bonus under statute payable even the name is not borne on muster roll on the date of payment. There is only condition of 30 days working during the accounting year.
