ESI AND WORKSMEN COMPENSATION BOTH ARE NOT APPLICABLE AT A TIME.iF esi zone is there then you have to giVe ESI FACILITIES OTHERWISE WORKSMEN COMPENSATION ACT WILL APPLY.

Workmen compensation and ESI is two different Act. If in your establishment there are more than 10 employees with and among then anyone is getting salary less then 15000 then you have to mandatory register under the ESI Act. As per Workmen compensation Act if the worker gets injured during the course of the employment then the employer has to compensate for the loss caused by the worker. If your establishment is covered under ESI, then that expense will be covered by the ESI and you need not worry. If ESI is not covered then you have to insure your works separately. If you did not insure your employees then you have to pay the loss caused to your worker from your pocket.
Both act can not be applicable at the same time in same organisation

Thanks for the valuable information. I want to know that is it necessary to cover under Esic in construction industry as because labour everyday came and goes out and not even that the place of working can also changed in some others kind of construction in re work, transmission line etc.

I think BOCW act may be referred to know more about this. Recently Constructions workers are also brought under esic.
