Yes.......Sanjeev sir....i agree with what you said but what if the employee is already on warning period.
In such case company posses the right to remove him.So now still company have to pay for his notice period also??

It is the desire of the employee to leave the services, you are not taking that decision, since it is his decision he needs to fulfill the condition of serving notice period, not yours at all. Under the circumstances you are doing a favour to him by waiving the notice period, as such you need not pay him any notice period. He will be earning the salary in the new company where he is going to join. Only when you decide to dispense with the services of any employee you need to give notice as specified in the appointment order and pay in lieu of such notice period, not other wise. Hope I made the matter clear.
