Hi Jagruti,
Since the company has declared 5 day working for all testing and others, it should be made applicable to all the staff members.
Depending on the no. of people working on these days, a holiday/leave policy has to be drafted, since the shops and establshments act makes it clear that the working hours declared and submitted to the department has to be uniform through out the organization. If the no., of people in the two slots are clearly indicated, a draft could be made.

HI Jagruti, as pe rmy experience in HR practice, Leave policy can be framed and same for every department and every employee who are on the payroll of organisation. and 10 Cl for year and 1 El for each 20 days working and yes if any employee is working on off day or holiday due to an emergency then he is allowed for leave as compensation and its true that Leave policy once for any company is applicable for each and every employee does not matter what level what grade or which department hope this will give you view when you prepare leave policy

Dear madam,
As per law which is not legal does not always becomes illegal. But in-between exceptions arises. If your management is ready to face all the loss-benefits w.r.t. to leave policy as directed by them, then you should not worry about.
Few points to be considered:
1. Maintain the written record of discussion as much as possible.
2. Show them the pros & cons of department-wise leave policy.
3. Discuss with department heads in informal way, about their opinion.
4. Minimize the difference between standard policy and department-wise leave policy, utilizing various conditions as flexible.
Advantages to follow above points:
1. Management will become more practical in its approach.
2. Employee can be convinced in more better way
3. Any issue could be resolved easily.
4. You would be more confident in policy implementation & its control.

Dear jagruti,
as far as earned leave concerned & cl concerned to be provided according to shop & establishment act. For testing & safety dept, they are eligible for avail weekly holidays. That is their rights also.if the factories act not applicable, earned leave & casual leave to be provided.
I don't understand one thing why such partiality? And discrimination? Equal benefits to be provided. If the above dept people to attend the work weekly holidays, extra amount to be compensated or c-off to be given

Dear Sir,
Leave policy cannot be department wise. It will be uniform to everybody as far as possible.
You are saying that one group is provided continuous holidays SAT And SUN days.
The other group is provided only 2nd and 4th week Saturdays as holidays. This can be done by the
based on the requirement of their work/exigencies of work in such department. We cannot say that
it is not correct. It is right in the perspective of employer. You may feel that it is wrong.
But final deciding authority is Employer. He is right - Nothing wrong in it.
