Mr Chandu, if you are the principal employer then you can ask your contractor to apply for the ESI code and deposit the contribution in that code. But if you are a contractor and you already have a code number then you can deposit the contribution in that number. It is the duty of your contractor to have a code number and deposit the contribution but the ultimate responsibility is that of the principal employer since the contract employees are working in his premises.
