The step1 i have already done and also planning to act on step 2.
And regarding step 3 i live in Mumbai and will be leaving for Punjab so if i left without the Exp letter/Relieving letter
I will not be entertained anywhere without these things as in future these two documents are very helpful and i can't afford to come back to Mumbai just to get my documents and that also is no guarantee as they are now not replying my mails what is the guarantee when i will go back they will revert me and will issue me the required documents.

That is OK but how about the relieving letter/experience letter as they are stating if i don't serve for 3 months they have sole rights to reserve to not issue me required documents and also these things are not mentioned anywhere in the HR policy sheet as well as in the offer letter which i got from my organization.

Since your Employer seems to be so adamant & insisting about the 3 months Notice Period, there does seem to be another possibility--that they don't believe you when you quote 'personal/family reasons' for the resignation.
Usually no company [UNLESS they have this sort of practice as 'generic pattern' with all/most employees] wants to hold-back someone who resigns UNLESS there's some KT pending OR any official issues exist OR they just don't want to loose the person. Every HR person knows that once a person resigns, there is VERY LITTLE possibility of sustained interest in the job--better leave him/her than to carry him/her along & effect the others in the company.

If the reason given by you is indeed true, then you should have shared a few details about the 'personal/family' issues with them--did you do that? Did you at least share 'informally/unofficially' with your boss or colleagues?
Pl clarify/confirm.
A lot could be dependent on your 'body language' during that process, which could be the cause for the present situation.

I have Informed them formaly and infromaly both still they are saying company holds the sole rights not to issue the relieving letter or Exp letter to me as no such clause is mentioned in my offer letter as well in the HR Policy sheet.

Hi Kapil,
Well I have gone through similar experience. Few thing which can happen are the following.
If you do not serve your notice period then company can mention you absconding or can put bad remark in your reference check. Whenever your Background verification will happen it will keep coming back to you. You have to convince most of the time to your new employer that it was not your fault and beg from them to give you joining. If you are lucky you will get joining otherwise you need to look for other company.
On the other hand if you left after serving one month notice it is possible that company can give you relieving and service letter with some bad remark on it like absconding or not served full notice period. You need to keep justifying everywhere with your communication emails that you did not do anything wrong.
Best strategy for you is to keep requesting from your current employer that they give you proper exit. Believe me if you have to beg for it better go for it for your future sake. forget your anger for the management . Also keep your future employer to wait for you as long as you can keep. I know your future employer definitely can wait if you pester them. Leaving without serving notice period should be your last option.

I am really Thankful to the suggestions given by you I will think upon the suggestions given by you hope my management may agree upon my request or if they went strict on there decision than can it be option tha i may send them notice reminding them about my rights as per the Clause's mentioned in there HR as well as in there offer letter.
As they are talking about the right's of Company than employee after getting rejected the plea several time can also tell the company about his rights as per law.

Hi,
I consider it best to walk upto the HR spoc and talk face to face. Accept no excuses and urge them to give a decision.
Being a part of HR, I understand they may not have the time to see and respond to many mails. However, it is in your best interest to address them directly rather than waiting and pressurising yourself.
Have you just sent a mail and waiting for their response? Or have you actually walked upto one of the HR department employees and spoken to them? Kindly clarify this first.

Dear Avani,
As i am at client Location in Mumbai and my HR is in Bangalore HO so its not feasible fro me to step into Hr department directly moreover the company is a consultancy company which works at client locations and provice support to the different products and it have 3 MD's who are managing and working with us on the the different projects and i ahev also in talks with my Md as well as my Manger, And the MD is also heading the product to whom i am providing the support he has given feed back that he can mange without me as i have stated my family issue directly in front of him, And my manger is not approving nor reverting on my mails regarding the resignation only today i got one revert as i stated that i am being very loyal employee of the Company and my plea should be considered as i work regardless of the no of hours i am working and also regardless of Day /Night, so he replied it was informed on day one that every operations team member has to available 24*7 to attend any kind issues raised.

And asked our HR that if he has to get relieved prior to 3 months notice period, then company reserves rights not to issue experience and relieving letters for him.
Please let me know how justified these words are as i am very much depressed being ill treated in this way on separation from organization though i have put options for buy out as per company policy. They are not ready to relive me .
Kindly suggest something on my condition.

My dear kapil,
Normally 30 days notice period has to be given or one month pay in lieu of that has to be surrendered and whatever leaves are balance , are adjusted in the notice period.You meet directly to the HR & sort the issue.
