As per your appointment letter if you had been appointed for particular post and you were drawing salary as per the grade, service period for payment of grauity to be counted from date of joining not from date of confimation.

Dear Asha, Yes You are eligible for gratuity, under gratuity act. Who are/were completed 5years (DOJ to DOL) they are eligible. Many companies will give gratuity more then 4.6 month worked employees.

Dear Asha,

As per Gratuity Act, you are eligible for gratuity after contiunous service of 5 years. Organisation rules can not over rule the Govt.Rules.

Gratuity will be paid at the time of seperation from the Company.

It is calculated as last Basic Salary+ DA/26 X 15 X No.of.Years ( In your case 5)

You have to make sure No Letter of Discontinuity of Service was served to you in the last 5 years for long absence or suspension. Leave With out Pay during the period also will be counted as continous service only until and unless they have issued a letter mentioning it as break in service and you have personally receioved the letter by putting your signature as receipt.

If they do not give you gratuity, tell the HR Manager , I am filing a case in Labour Court as per Gratuity Act.( Print out a Copy of the Act and read /keep it for further action.)

Gratuity is your right, you have earned it after loyal and sincere service of 5 years with the company. Now adays, it is very difficult to find people like you who stick with the same organisation for such a long time.

yes probationary period is considered whilr calculating the gratuity,,,because it considers the no of years of service you finished in the industry but it does not include whether you worked as probationary or permanent employee ,,,,,,,more than every thing it depends on the standing order of the company in which they will clearly specify the criteria to claim the gartuity ok go through your company standing orders first,,

Yes probationary period should be consider for eligiblity for calculation of gratuity as because probationer is also an employee of the company it may be for term basic and drawing all the benefits of regular employee.Payment of gratuity is done only after the completion of 5 years of continues service. In Each year the working days should be 240 days will be must.
