Can you please clarify two things....
First, She has been on leaves since July 2010, she is getting maternity benefit from ESIC right? but then why are you giving her paid leaves now in February.
These earned leaves if she was eligible for them should be paid in August or September 2010 salary....
these 30 days paid leaves should have been given to her last year itself as the maternity benefit she will get from ESIC is for 3 months only...
Do what is right as per the rules....which is to pay her those 30 days for 2010.
