Please try to make a peaceful exit from that Company. Leaving the company doesn't mean you would not have any business to with them. That company can make or break you if not now but in the future. So my last word is, make a clean and peaceful exit from your previous employers.

Better to continue the relations hence it is better to have a discussion with the HR Head and leave the company with a good note.
Nobody knows tomorrow if this company sends a copy of the notice to your new organization then you will be in loop hence better to serve for 28 days or pay the amount in lieu of notice period.

It is important as employees to note that employers are not interested in employees that show desperation when looking for a job. Giving reasonable notice period is a mandate for both parties in a contract otherwise legal action is an option for non compliance. Even if your prospective employer has not considered your current position the truth is that you will still need the reference for future reference.
Give notice or be ready to ay the employer in lieu of notice.

Dear Sunny,

You are just two months old in your current employment. Therefore it is safe to presume that you are still on probation. Please read the relevant clause in your Appointment Letter and then draft your resignation letter accordingly.

You must take care to word your resignation letter. In case you do not wish to give to the Company the prescribed notice during your probationary period, request for an early realese and offer to surrender/pay salary in lieu of the said notice. You will be on sound ground then.

Hi All,
Thanks for your suggestions. I really appreciate your feedbacks.
Based on that, i resigned from my present organisation giving them 23 days of notice and now I'll refund back the whole relocation expenses also.
I think now they'll have to give me relieving as well as experience letter as I am going in a legal manner.
Is they any clause that when someone resigns in probation period then he/she won't be applicable for experience letter and relieving letter, is this type of company clauses really exists ?
Secondly, is it possible if my company can waive of the notice pay and relieve me early ?

Dear Sunny,
Be professional, you must complete your notice period & hand over your charge. So Plz. do not try to do as you have planned. It may affect on your new job.
As you said, you are not taking the experience letter for two months from current employer. This will also affect on your CV. Your CV will shows that you were job less in that two months.

in that case, its a Gen / Moral obliege of an individual to inform / discuss with Hr. Take decision accordingly
Even if company wants to move legally, they may press on absent without notice and there by the loss to the company.

Hi,
I am appointed as a Officer in the Private company but I have work only one day but in that day I did not did any practically work as well as no training is also provided after that I am suffered from fever than next day I told that today i will not come today after that day I told that i am not coming because my family is not sending me now they send me the letter but yet I am not received the letter please tell me that whether I have to accept that letter or not and what will be written in that letter please help me... In the appointment letter there is written to give the one month notice period otherwise pay the one month advance salary to the company.
