According to my knowledge
1. pf is mandatory.
2. the the employee wants to pay more in the pf account that is his choice
3. the limit is now Rs. 6950/-
4. the employer has to pay the pf amount in the employees' pf account every month/year!
am i on the right track?

If the employee is already covered employee having account number and contributed to pf for some time and he changes his employment or his salary (basic+DA+Retaining Allowance+Food concession) exceeds Rs. 6500/- in such cases pf has to be deducted compulsorly and there is no escape on the ground that his salary exceeds Rs. 6500/- On the other hand if you have taken an employee who was not the member of the PF earlier, the coverage under PF is optional and according to the wish of the company/employee.

Provident Fund has to be deducted on Basic + DA total, but if the employees total exceeds 6500/- including Basic + DA then also it has to be deducted on 6500/-

You are right. IF any employee joining newly and even though his basic is above 6500/- and he had EPF in earlier company then sure even in this organisation EPF contribution of upto 6500/- is mandatory.

Hi Jeena,
As per rules only employee contribution of 12% on basic will be deducted in Employee wages. Remaining Employer contribution of 12% and 1.61% of Admin charges are supposed to be contributed by the employer. But now a days in few IT industries both employee & employer contribution are deducting from employees CTC. They are clearly specifying as both the contributions are included in CTC.

If at joining the basic is more than 6500 than the employer is under no obligation to contribute 13.61% pf toward the pf account but the employee may opt for the contribution minimum of 12% and maximum of 24%, but if the pf has already opted when the basic was below 6500 and due to any reason it crosses 6500 the employee and the employer have to contribute 12% and 13.61% respectively. If the employer opted to contribute pf before the year 1997 and the number of employees were less than 20 as per factories act 1952 and provident fund and misl provision act 1947 than the employer is allowed to pay of minimum 10% contribution.

In the construction & caterring industries, the direct labour come and work less than 60 days, and get as wages as per minimum wages act ,. but wages are paid on daily basis been lass then 6500/- . have the Company for whom they work deposited Provident fund for them ?

Thank you for the reply. But will that be a problem for the company if any of the employees or previous employees raise an issue regarding deduction of both side PF from the CTC ? Is it the right thing to do from the company's part ?
