As immediate employer, the contractor has to cover their workmen under PF and ESI. If EsI coverage is not there, He has to take WC policy .It is the principal employer's
responsibility that the contractor pays in time.
However, if the contractor is not paying the principal employer has to pay.Hence, the principal employer has to check up the statutory documents of the contractor every month and ensure the same.

PF & ESI has to be paid the contractor for his employees. However, if contract fails to pay, the Principal Employee shall on behalf of contractor & the paid amount shall be deducted from the amount payable to contractor or it can be claimed through court of law as due payable to Principal Employer.

But i would like to ask you one thing that, if in case the contractor have less than 20 Employess, then does the Company or say the principle employer is liable or PF, or is the contractor liable for any PF.
Kindly clear my this confusion

Employer means person who engages the service of an employes .thus it includes both Principal and Contract employer.
For the contract employees, the contractor has to deduct and contributions to PF & ESI authorities. Principal employer has to ensure the deductions & contributions.
