We have written a company policy on the same lines of the suggestion given by Autumn Jane, so as to take care of the interest of the organisation and the employee.
Over and above that, it's a suggestion to possibly consider setting up a Benevolence Fund in the company. This fund will allow for a % pay out to family members of employees who have been diagnosed with long term ilnesses or been inconvenienced due to natural disasters.
Once again all these suggestion really depends on the invlovement of top management and the level at which they are willing to invest on the employees.

If the person has been on the job for a period greater than 10 years, treat it as VRS and give a good compensation. Also some medical expenses can be defrayed by the company. The best company is that which would treat the employee as if he were the owner, depends on money available with you. But always cos should remember, what goes round, will come back and this act of goodwill will be returned by nature manyfold. However, if the co is not in good financial condition, then give job to his wife or child... Options are many if the WILL is there. In these cases LAW IS AN ASS. Is the employee not covered under ESI...

It's good to see responses to your questions. But meanwhile at ground level that employee would still be in trouble in terms of monetary part. If it all possible share with us his account No. i would deposit some amount to his account to help him fight this kind of difficulties of corporate world. & i believe this can be the best way, as there as thousand of citeHR members if they can contribute a little it can be an immense help to this guy. I am ready to contribute some amount his account. Because tomorrow nobody knows what can happen to us in this corporate world

I have had such an Incident in my previous organisation. What we did is that we (Management) said, will wait for one year for him to recover and we paid him salary for 12 months. WE also informed his family that we will support them by paying salary for one year and after that if the situation continues, we will releive him from our organisation and will not pay any salary thereafter. Also we told him that whenever he regains his consciousness, we will rehire him at an appropriate level at the point of time. Acutally, he didn't recover after one year and we after paying salary for 12 motnhs, releived him from the company.

The same case had accured in our company. Our driver mat with an accident, lost memory and even lost his legs in accident. Till date we have spent Aprox Rs.25 Lacs out of that amount Rs.20 Lacs have been spent for Operation and Medical Treatment and balance to help his family.
Individual can not bear the expenses like a company. No body (Statutory Auditor) will take objection for this type of help. This type of help increas moral of all the employees.

Here rules plays not much role in this situation but rules are made to brake, if their is any rules exists.
Its a challange for HR to justify both the employer as well as employee.

Whether the accident occured "IN THE COURSE OF EMPLOYMENT"?, if you are liable to pay him as per "Employee Compensation Act" or the company benefits whichever is higher.
You can provide the victim;s family a "compensationate apppointment" , if ur company has such policy.
Normally big company will have insured employee, arrange to get the compensation....
