Take him as consultant or extend his service till you need. No matter what his age is, until person is physically and mently fit to perform his duties.

Dear Rajesh,
If an employee is about to retired the following steps to be followed :
1) Ask him to submit resignation & make his settlement (if he attained age of retirement resignation is not mandatory) and issue a letter from your end stating that he has attained the retirement age.
2) Take him as Retainer on FTC (Fixed Term Contract) for eleven months ( Make separate appointment letter) , no statutory benefits to be given to him as he / she was retired from the services of the company.
3) If company wants to deduct PF they can deduct 12 % on (Basic / consolidated pay ) no EPF should be deducted, If employee is working in AP P.Tax to be deducted.
4) And finaly his job nature should be consultant basis and it should not be regular basis.
