Thanks for your valuable reply, i have another question regarding PF.
If an employee joins the organization where employer is not deducting the PF at all since all the employees in his organization are getting more than 6500/-basic salary.this new person also has basic more than 6500/- but in his previous organization his pf was deducting.
so my questions are
1) can he compel the current employer to deduct his PF.
2) if he cant compel the current employer then can he withdraw his PF from authority.
3) what if his basic salary is less than 6500/- , can he compel current employer to deduct, but as per PF act there should be 20 person working for deducting the PF or he has another choice?
pls let me know if you need more info.

As per rules,if u r basic+DA < 6500 u ll entitled for the 12% deduction from ur salary.
If u r basic+DA > 6500, there also u ll entitled to get PF Deductions but that deduction amount will be standardized on 6500 only.So employees will not get deducted morethan 780/- per month even if his salary is in lakhs.
That is the rule followed by all most all companies.
In some companies, irrespective of salary PF will be the optional choice to the employees.if he wish to deduct ,company will allow.

If an employee who who earlier covered by PF in the past employment joins with a salary of more than Rs 6500 and the present employer refuses to give him PF, there is no option to the employee. He can retain his scheme certificate (if he has) till he joins another employment where he has PF or till his attaining the age of 58 for getting pension.
For coverage of establishment only the number of employees is considered. If there are 20 employees then the establishment will be covered and if out of this twenty employees all are getting salary above Rs 6500, all employees will be excluded. Still the coverage to establishment will be there. Suppose, a new employee joins and his salary is below Rs 6500. Naturally, he will be covered and the company can not refuse to contribute PF on the ground that the number of persons getting salary is not more than 20.

one of my friend company had an PF Inspection and whereby the PF Inpectors had stated that the deduction which is done for PF is not correct and legal.They have demand for the balance remitted amount
Actually in My Friend Company for PF deduction is calculated based on the Basic Pay
According to the PF Inspector the PF deduction should be done on Basic wages which comprises all the allowance except HRA, incentive, commission, Bonus
Salary structure of Friend company is as follows
Basic pay
HRA
TA
OA
Please suggest what should be the actual calculation.
