We have engaged contract workers in factory environment. We are under factory Act due to working in in factory environment. As per contract labour act if a workmen works for 240 days in a calendar year will be entitled for availing annual leave or leave encashment. But the principal employer is insisting to make the leave encashment even the workforce not completed 240 days of service.
I would like to know is there any such provision for leave encashment for contract workers. Can a workforce eligible for leave encashment even though not completed 240 days of service.
Please advice me on the above subject.
