Well, i can say it depends organization culture. Some organization issues only offer letters , joining date also will be mentioned in that too. Based on the receipt of such offer letter employee may resign and accordingly join the particular company which issued the offer.
The organization cannot deny the job offer letters unless it expires as per mentioned date on that.

Offer letter indicates that,we are offering this position to you and the pay and all other remaining terms and conditions of the company,if the person agrees for that and he must return the same xerox copy of offer letter to the company,after that only a company will issue an Appointment letter to that person.Appointment letter confirms that, he is coming under the roll of the company,this is what we are following in our company.If iam wrong please let me know.ManjushaHuman ResourcesHyderabad.

what aver it may be offer letter or appointment letter both are important but one more thing
if terms and conditions are acceptable and both side are agreed with that than you may proceed, otherwise any one from eithside may be withdraw the offers.

Many companies have different procedures. however, I would like to deal with the legality of these two letters.

Let us start with the first and foremost issue of any employment......an employment is contract between the employer and the employee.

Start with this fundamental.

When an offer letter is issued with all terms covered including date of joining and specifying that the letter shall be returned within a stipulated period, it is the first step of the contract.

Then the employee signs the letter , hands over the same to the employer and says that he would join within the stipulated time, the contractual obligation begins for both parties.In fact the employer can not withdraw the offer and the employee can not avoid joining. In fact if an employee does not join, legally the employer can sue him for breach of contract.

An offer letter duly agreed by the employee completes trhe process of contract and hence there is no need for an appointment letter.

Consider an offer letter does not say anything about notice period and the appointment letter talks about notice period, then the employee can say that he was not told about the notiuce period before he resigned from his previous job and hence he can not accept the same, his plea will be upheld by any court.

Hence it is essential that offer letters are exahustive, and the organisation must get it duly signed.

If thius process is in place, then there is no need for an appointment letter. In fact, I do not advise two letters as the terms in the appointment letters can be questioned

Yes, it is mandatory to issue an appointment letter if a person has joined. Offer Letter mentioned only "Designation & Gross Salary ". The employee Responsibilities , duties, nature of work, Salary break up, termination details mentioned in appointment letter (or) Detailed offer letter. and also Notice period, termination details mentioned in Appointment letter only.

It is not mandatory to issue the appointment letter subsequent to issual and acceptance of the Offer. Because when offer is accepted, it becomes a contract of empoyment (Indian Contract Act). Appointement is afterall a contract between the employer and the employee.
However it has become the practice to issue appointment letter followed by Offer Letter.

Hi all,
Different between Offer letter & Appointment Letter are:
Offer letter : mean we have offering Job to the candidate for his /her good performance in interview (ending time), and its depend on him/her for accept or not.
Appointment Letter: mean when candidate accept our Job offer and He/she want to join our organization, that time we have to issue this letter instead of offer letter.

Offer letter is usually a confirmation of an employment offer to the candidate and it contains details of salary break up.It is to bridge the time gap between oral communication to the candidate about him getting selected & the actual generation of appointment letter.In companies like mine, appointment letter is only generated after submission of relevant documents & satisfaction of medical examination.
An appointment letter is however issued only after the candidate submits relevant documents (degrees, certificates,bonafide letter,relieving & experience certificate from past employer etc) & clears the pre employemnt medical test. An appointment letter also contains terms and conditions of employment.
