I wish to appreciate your efforts in giving a helping hand to your colleague's family, the needy. May the soul rest in peace. In addition to what Mr.Kalsi has stated pl. guide the concerned to accomplish on the following-

1. I'm not sure where you people are working. If your estt. has any provision to grant ex-gratia amount to the deceased family, try to get them. Some states also have such schemes to grant death relief.

2. If the scooter's insurance is valid lodge a claim on the Insurance co.

3. If police has been informed, please ensure a certified copy of FIR is obtained and attached to all your claims-most probably Police Dept. would have regd. a "Hit and Run" case since the second party, the culprit is yet to be identified. It's the duty of the Police to track down the culprit. If he/she is identified and a vehicle is involved pl.arrange to lodge a claim on the insurance co.of the other vehicle involved in the scene.

4. It may be necessary to first check for availability of "nomination" under EPF/Gratuity filed in your office, this will help to hasten the claim settlement. If there is no nomination filed 'Succession Certificate" may be insisted. The widow may be entitled for a pension pl.check that.

5. If your office disburses the salary thru' employees' bank a/cs, the wife of the widow should pursue to claim the balances in his bank a/cs. Most probably bankers may ask her to submit "succession certificate" from a competent court. This would involve "stamp duty" %age based on the amount of claim. There is a shortcut, by producing NOCs from the surviving family members (possible claimants) like children, parents (in-laws), brothers/sisters etc. Nowadays every Bank account is also backed by insurance policy, ascertain details if any from the bank.

6. If your office have a scheme to grant "appointment on compassionate grounds" to the widow, dependent children of the deceased, pl.pursue such a scheme to help the family.

7.Check for any Life insurance policies your colleague would have taken and contributing.

8.Try to obtain a copy of his "Postmortem report" and examine whether there exists any clue/suggestion which may throw some light of his tragic death.

Pl.keep updated and follow up this consistently till everything gets over. You have to run pillar to post to get all these done. Your efforts will not go without a blessing.

Please confirm whether you or your establishment has submitted accident report to the appropriate branch office of ESIC in respect of said accident of the employee. If so, what action has been taken by said office so far ?

Hi,
Good to see your response, pls lodge complaint through concerned police station where the person met with accident, i hope panchanama / post mortem has been done for the person who met with accident. Lot of lawyers will help in this case, even they will pay maintenance charges which will be recovered on getting back the claim. This case may take atleast 3/4 years. In order the help the family in addition to the insurance amount paid to him i.e Rs.1,60,000/-.
Secondly, enquire the family whether any LIC Policies are taken by the person.
Enquire or refer the history of employment and whether what is the length of service before joining your company. His family is eligible for drawing pension, refer the nomination forms submitted by him.
The accumulated PF can be drawn by his nominee which you need to process and submit.
