Hi All,
I am a HR Executive in a start up where in we still dont have Leave policy in place.
Please help me & give me information on payment for sick leave availed by the employee during probation period. Is there any legal obligation for the company to reimburse the medical expenses.
Please let me know at the earliest.(In this case the reason of sick leave is not genuine)

Strong reason: If employee get sick within 6 months of joining means he is not medically fit except few case. so should not be given such benefit during PP. Regards Sidheshwar

Sick leave provision exists in some states under the shops act.It would be appropriate to check on this.In karnataka it's 'accident cum sickness leave'/
During probation period sick leave non sanctioning of leave as a general rule would not be appropriate.Cannot an employee fall sick during a probation period?.ESI provides for coverage during this period.Well non esi category have to examine the genuineness of the sickness [which can be verified by various ways } and on a case to case basis the leave can be sanctioned against future leave credits.When retention is a the mission statement in HR today....this apt considerations would send the right signals.Companies covered under insurance schemes do make a provision from day one!And some have included hospitalization !

Hi Roopa,
Sick leave , we believe as a good organization which believes in good HR practices should allow a provision for sick leaves which are a genuine cases like we had an employee who was down with juandice..was allowed sick leave against his would be entitlement of SL on his confirmation..
Mind you this has to be a case to case basis..one can draft a policy or mention clearly in the employee manual that leaves are not allowable during the probation..if it is on a genuine case which would be considered in consultation with the concerned HOD..

Dear All,
I would be grateful for advice in one of case which occuried lately in our company. During probationary period one employee had accident - everything was done proper with insurance and documentaion, but he was on sick leave due to this accident around 3,5 months. Our probationary period according the agreement is 4 months- my question: we want to cancell probationary period during his sick-leave that it's starts from begining when he is back in work. Can we do it by oral- just to inform him?or we have to write prolongation paper - if so, do you have example of it?

I agree with Mr. Rajarama and Mr. Rajat. You can always take a medical certificate and get it verified.
Dominika_Incase you want to prolong the probation period you need to give it in writing to the employee and also get his signature for his agreement for the prolongation.
