Dear Rishi,
As far as i know if the director is the employee of your organization,what i mean over here is he/she should not be honorary director or in some cases professional director as mandated by SEBI.
In that case gratuity is applicable to him.
I request to refer gratuity law for better understanding of it,its better to collect multiple opinions on it.

If gratuity limit is Rs. 3.50 Lacs, but an individual's basic salary is 4.0 lacs per month, in this case how can we calculate the gratuity? pls clear me.
more than Rs. 3.50 lacs gratuity is payable or not?

Regarding your clarification that depends upon how ur gratutity made with there are two ways one is as per gratutity act and another one is employer wishs, so if u want to be in 1st catogary there is limit up to 3.50lakhs but if u have made any agreement with lic like u have the trust deed and there is option u can get if employer wishes

Dear Rishi
Director of company is eligible for gratuity even A Director of a company not having ultimate control over the management of compnay will be an employee to be entitled to gratuity under the Act (Monitron Securities (P) Ltd v. Mukundlal Khushalchand Dhavan, (2001) 1 Cur LR 507 (Guj)
