We have recruited ITI Temp. workman. we have offer them consolidate salary Rs.4000/- . we have not given break-up Rs.4000/- like Basic and SPL allowance. See, SPl allowance has increase every six month. it may salary increase due to SPL allowance every six month. but we would like to give Rs. 4000/- only. its is more than minimum wages. I would like to asked you current rate of the SPL allowance is Rs.686/- per month but we are not specified in their salary. is it nessary to specificed SPL allownace as per goverment rules. what is the regal value of the "Consolidate salary" in the labour law

Hi,
You dont have to state salary brake up in the appointment letter of a temporary employe. It is true that if you are paying more than the minimum wages the 'Inspector' will not trouble you. However you need proper salary brake up in the muster cum wage register for the purpose of calculation of E.S.I. and P.F. contribution. Otherwise you unnecessarily pay extra E.S.I., P.F. contribution on the entire amount of salary which may include allowances.
