Dear Malik
Greetings.........
I wish to know the implications of Section 54 of the Factory Act 1948, re-produced below?
Regards,
V K Gupta
Daily hours.
54. Daily hours. Subject to the provisions of section 51, no
adult worker shall be required or allowed to work in a factory for
more than nine hours in any day:
1*[Provided that, subject to the previous approval of the Chief
Inspector, the daily maximum specified in this section may be exceeded
in order to facilitate the change of shifts.]

From India, Panipat
Section 54 restrict day's working hrs of an worker to 9 hrs, simultaneously give power the Cheif Inspector of factories to releaxed/exempt any class of factories so as the change of shift can be accomodate.

Further Section 64 of the Act give power to State Govt thereby exept any factories or class of wokers as mentioned in various sub-section while making rules but while making rules the overtime limit should not exceed 10 hrs in a day and 60 hrs in a week and 50 hrs in quarter.

Add to this section 65 give power to make order of exemption for relaxation in working hrs/overtime and maximum limit. while making exemption order the should restrict working hrs not more than 13 hrs in a day including rest and spread hrs, again 60 hrs overtime in a week and maximum 75 hrs in quarter.

the difference between section 64 and 65 is far as my understanding, The goverment can make rules by its own under section 64, but the order under section 65 for exemption shall be made on making application for exemption as envasiged by section 54.
