What if the employee is searching for a job during the probation and has also signed the Service Agreement for 1 year? The employee has been giving the interviews and also is pursuing online certificate courses from the office. The employee has been assigned a task by the manager, which is being carried out. If the person leaves or resigns what actions can be taken? Please seek your input.

What was the separation clause as per your Appointment order? If the employee leaves without information then disciplinary process to be initiated. As long as employee follow proper separation process he/she can be relieved properly.


Now as the employee is still working with you, just find out why the employee is looking for a change?

As the employee has signed the Service Agreement for one year, the rules & regulations stipulated in the Agreement shall be binding on him. What does the agreement say on Separation? Any mention of the compensation/damages, in case of early exit? Please throw some light on this.

Any how, continuing in service in a company or separation from job is purely sole decision by any employee. If he has got some talents which may contribute to success of the organization, please initiate steps to retain his talent /service with the company.

Employees are at their liberty to pursue any course and enhancing knowledge. But he should be
clearly instructed to not to use factory/office duty hours for online study, as engaging in any other
activity which is not related to his work shall be liable for strict disciplinary action. Please frame a policy on this and put it in place before initiating disciplinary action.

Dear Jidnyasa-Nashikkar,
Your contention seems to be that a probationer during the subsistence of his bond period of service should not seek for some other suitable job of his choice. I don't think it is correct.
Particularly when you have no issues with his performance, you cannot complain about his pursuit of on-line studies.
If he breaks the bond before its expiration, you can resort to appropriate legal action as per the terms contained therein.
