If an employee left the job without proper notice period then is there any rule and regulation that he can take his balance salary? But he has 2 month notice period in his appointment letter and he has given only 1 month notice period and also did proper resignation on mail.

If at all you have mentioned the Notice period very clearly in the employment contract then the same is valid document for you.

Hi,

Absconding from employment without information is not right and cannot be justified at any cost.

When notice period as per appointment order is 2 months either you should serve two months or negotiate with employer for partial notice and make payment in lieu of balance notice period. Emailing resignation or submitting resignation is not the criteria but serving proper notice period and handing over the responsibilities properly is very much important.

If the employee is bound to serve 2 months notice period but not served, then employer has every right to recover salary in lieu of notice period. If the above cited post, it is noted that the employee has served one month notice; so either employer may recover the balance notice period payment, or, the concerned person may be advised to buy the remaining notice period, by depositing requisite amount to the company.

You can not say no to wages and salary for the period of work.
What does it mean "did proper resignation"? It is
presumed that mostly things in your organization are not in order.
Send a mail to that person, stating that your wages pending with us shall be adjusted against the shortfall notice period.
