We have a labour contractor under whom our Thika employees are registered. Now can I appoint a labour on behalf of the contractor. All formalities will be covered by the contractor?

Appointing a worker and deciding the wages payable to a worker on behalf of the contractor may make the contract SHAM. Therefore, you should avoid such acts of directly involving in to the matters of the contractor.

I differ with the proposed suggestion. There are cases when Supervisors or even Managers are contractual. In those cases it will be better to have input from PE as the concerned employee will add value to the PE's organization.

Obviously there should not be any official record. PE's representatives will take the interview, may help to fix the remuneration etc., but the entire process should be in black and white under the contractor's domain. For workmen probably Contractor will be capable to do the job, but if required PE's representative may interfere.
