Can we remit contribution to their EPS account in EPS though some employees have been member of EPS earlier. But previous employer haven't remitted amount in their EPS account.

Moreover their wages is beyond ceiling limit as defined in EPFO.

I believe that the employee is question had joined some time after 1st Sept 2014. At the time of joining his salary was above Rs 15000. Therefore, the then employer did not cover him under EPS but the entire contribution of 12% payable by him was paid to EPF along with the employees contribution of 12%. Now he has changed the job and joined your company. His salary is still higher than Rs 15000. Your question is can you pay the contribution payable (8.33%) to pension fund? The answer is NO. You can continue with PF, with same UAN, and you can pay your contribution exclusively to Provident Fund only. Very simple, an employee joined after 2014 Sept 1, whose salary exceeds Rs 15000 cannot be a member of Pension Scheme.

As per the original post, some employees were member of EPS. But previous employer had been stopped to deposit EPS contribution even they were EPS members as their salary crossed 15k per month. Once the member of EPS with eligibility limit and for continuous service the same cannot be discontinued even the salary crossed 15k per month.

In this case the previous employer by mistake stopped depositing contribution to EPS as the employees at the time of joining salary was more than 15k per month. This is a complicated issue and suggest to talk to local EPFO Office for proper clarification and action plan.

Dear Nanu, I think it was not by mistake but, as I have put in, since the employee's salary was above Rs 15000, the previous employer gave him PF on the ground that it is a good investment for the employee as part of employee welfare but did not contribute to PS as it was not possible then.

Anyway Prashant has to clarify the things. Let us wait....
