Dear Experts, Is lunch break included or excluded while we calculating daily/ weekly working hours in the public sector manufacturing industry in Karnataka. Regards, Amit

In any factory shifts may be - 6 am to 2 pm, 2 pm to 10 pm , 10 pm to 6 am (next day) and General shift may be from 9 am to 5.30 p.m.

In morning , evening and night shift it is not possible to work 8 hrs with half an hour lunch break but in general shift it is possible to work 8 hrs and half an hour lunch break.

As a practice most of the organizations are paying 8 hrs payment in case of shift duty other than general shift working 7.5 hrs.

I have no idea what Karnataka public sector manufacturing units are following.

08 Hours shift is counted in Continuous process , where machine or production cannot be stopped; and where production and machine stop during the lunch hour the duty hour will be for 08:30 Hours including 30 minutes for lunch. for both case you have to take the approval from the concern authority .
in some industry General shift is for 09 Hours because they provide 01 hour for lunch but overall duty timing will be 08 hours in a day.
in General shift mainly commercial staff or indirectly non related with production department employee work as like HR, Finance, Account, Senior Management that's why we count 08:30 hours as General shift.

Sec-58 of the Factories Act, 1948 stated Prohibition of overlapping shifts. Therefore, whether it is continuous manufacturing process ( eg. steel plant etc.) or a non continuous manufacturing process ( any normal engineering industry- Tool Room etc.) - it is not possible to allow work for 8.5 hrs duty including lunch where the organization is working in 3 shifts. In those cases working hours will be 7.5 hours and half an hour will be lunch break.

In case of general shift it is possible to work 8.5 hours as it is only one shift.

In my starting of career (1976), I worked for Guest Keen Williams Ltd ( GKW, MNC) where in Sankey division after agreement with union morning shift was 5 am to 1-30 pm, 2nd shift was 1-30 pm to 10 pm & night shift was 10 pm to 5 am (next day) when working hours at night shift was 6.5 hours and half an hour was rest but paid for 8 hrs. But in morning and 2nd shift the working hours was 8 hours and half an hour rest.

There is no provisions to obtain approval from Factory Directorate for normal shift roaster. The shift roaster should be displayed in the notice board and based on rule of the different States in India it may be forwarded to factory directorate. So far my knowledge goes, other than special arrangement ( say spread over more than 10.5 hrs etc.) when approval from factory directorate will be required.
