My CTC offer letter says this clause: encashment of accumulated PL (maximum 240 days) on completion of full tenure.

The question is: what is full tenure. company has not mentioned the full tenure term. Now the company is saying full tenure is retirement and we cant pay for resigned employees. Please help what legal action can be taken.

Full tenure would mean till the age of retirement. But that doesn't mean that in cases of resignation encashment of accumulated Privilege Leave is disallowed in between. An employee on resignation is to be paid the encashment of leave at the credit within two days of separation. Are you working in a factory or office establishment? pl clarify, we can guide you more.

Please note that under the relevant provisions, only 30 days EL or PL can be carried forward at the end of Calander year. As such you are eligible for encashment for maximum 30 days plus leave earned during current ongoing year subject to credit in your account. Regards
