Hi, I have a query, that one of our employee taken leave from Monday to Thursday, and succeeding Friday is a holiday and he joined to duty on Saturday itself.
In this case, shall I consider 4 days' leave, or do I want to take 5 days as leave considering that 1-day holiday?
Kindly help me to solve this issue

Since these are recurring issues, Pl lay down a policy/rules regarding such matters. As such, a holiday can be suffixed or prefixed to the leave and it will not be counted as leave day provided the employee has worked on the preceding/succeeding working day. Frame a policy and communicate to all employees, so that it is uniformly applied to all.

Dear Prasoona-Subhash,

The employee on leave from Monday to Thursday, and succeeding Friday is a holiday. In this case, you should consider 4 days' leave excluding the Holiday.
Further, these type of problem arises and creates dissatisfaction in mind of employee in absence of a leave policy for the establishment. You being the HR frame the leave policy to avoid such inconvenience in future date.

Hai,

Kindly make a policy and follow accordingly,

Meanwhile, refer the TN Industrial Establishments (NH, FH & Special Holidays) Act, 1958, that mentioned in Sec 5 as follow.

[Provided that no such employee shall be entitled to be paid any wages for any
of the holidays allowed under section 3 other than 3 [the 26th January, the 1st May, the
15th August and the 2nd October] unless he has been in the service under the employer
for a total period of 30 days, within a continuous period of ninety days immediately
preceding such holiday.
